Welcome to Lovepetura™ (the "Site"), operated by Lovepetura ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, products, services, and any related content or communications (collectively, the "Services").

BY ACCESSING, BROWSING, OR USING THIS SITE, OR BY PLACING AN ORDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE SITE AND SERVICES.

We reserve the right to update, modify, or replace any part of these Terms at any time. Changes become effective upon posting to the Site. Your continued use of the Site or Services after modifications constitutes acceptance of the revised Terms.

1. Definitions

"Products" refers to all pet hydration products sold through the Site, including but not limited to Lovepetura™ dog fountains, filters, accessories, and any future product offerings. "Customer," "you," or "your" refers to any individual or entity accessing the Site, creating an account, or purchasing Products. "Order" refers to any request to purchase Products submitted through the Site. "Content" refers to all text, images, graphics, logos, trademarks, videos, product descriptions, reviews, and other materials displayed on or made available through the Site. "Consumer" means any Customer acting for purposes outside their trade, business, or profession.

2. Eligibility

By using this Site and placing an Order, you represent and warrant that: (a) you are at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater; (b) you have the legal capacity and authority to enter into a binding agreement; (c) you are not barred from using the Site under any applicable law; and (d) all information you provide is truthful, accurate, current, and complete.

3. Account Registration

Certain features of the Site may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We reserve the right to suspend or terminate any account.

4. Products and Product Information

4.1 Product Descriptions. We make reasonable efforts to describe and display our Products accurately. However, we do not warrant that product descriptions, photographs, pricing, or other Content are accurate, complete, reliable, current, or error-free. Nothing in this Section limits your statutory rights as a Consumer, including the EU right of withdrawal described in Section 8.

4.2 Product Availability and Pricing. All products are subject to availability. Prices for Customers within the European Union include applicable VAT where required and are shown in EUR. For other destinations, prices are shown in the relevant local currency where available. Shipping fees, customs duties, and import taxes may apply depending on the destination. We reserve the right to change prices at any time. Obvious pricing errors may result in an order being cancelled and fully refunded.

4.3 Not Veterinary Advice. Our Products are intended for general pet hydration and care and are not intended to diagnose, treat, cure, or prevent any disease or medical condition in animals. They are not a substitute for veterinary care. If your pet has health concerns, consult a licensed veterinarian.

4.4 Electrical Safety. Our fountains may require connection to mains power. Use only as instructed in the product manual. Keep electrical components away from water except as designed. Results and suitability may vary depending on your pet and household; testimonials represent individual experiences and are not guarantees of specific outcomes.

5. Orders and Payment

5.1 Order Acceptance. Placing an Order constitutes an offer to purchase. All Orders are subject to acceptance at our sole discretion. We may refuse, cancel, or limit any Order for reasons including product availability, suspected fraud, or pricing errors.

5.2 Payment. Payment must be made in full at the time of purchase using an accepted payment method. You represent and warrant that you are authorized to use the payment method provided.

5.3 Taxes. For EU deliveries, VAT is included in the displayed price as required by law. You remain responsible for any other taxes or customs duties applicable in your jurisdiction for non-EU deliveries.

6. Subscriptions and Recurring Orders (Filters & Accessories)

Certain Products, such as replacement filters, may be available on a subscription basis ("Subscribe & Save"). By enrolling, you authorize us to automatically charge your designated payment method on a recurring basis at the interval selected at checkout until you cancel.

You may cancel at any time. For EU Consumers, any cancellation received before the start of a new billing cycle takes effect immediately for that cycle, as required by applicable consumer protection law. For other Customers, cancellation requests received fewer than five (5) business days before the next billing date may take effect in the following cycle if the charge is already in processing.

Orders already charged and shipped at the time of cancellation are subject to the return and withdrawal rights in Section 8. We will notify you via email of any subscription price changes before your next billing cycle.

7. Shipping and Delivery

We ship to selected destinations internationally, including Germany and other EU member states. Available shipping regions, delivery times, fees, customs duties, taxes, delays, and return procedures are described in our Shipping & Return Policy, which forms part of these Terms.

For consumer orders, risk of loss passes to you upon delivery to you or a person you designate. EU Consumers additionally benefit from statutory rights: where applicable, risk passes on handover to the carrier in accordance with mandatory EU law, and delivery must occur within thirty (30) days of the order unless otherwise agreed.

If your order has not arrived within seven (7) business days after the estimated delivery window, please contact info@lovepetura.com so we can investigate.

8. Returns, Withdrawal, and Refunds

8.1 30-Day Money Back Guarantee

We offer a 30-day money back guarantee from the confirmed delivery date on all Lovepetura™ Products, subject to the conditions below. This guarantee is in addition to, and does not limit, your statutory rights.

8.2 EU Right of Withdrawal (for Customers in the EU, incl. Germany)

If you are a Consumer in the European Union, you have the statutory right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period begins on the day you (or a third party named by you) take possession of the goods.

To exercise the right of withdrawal, notify us at info@lovepetura.com with a clear statement of your decision. Meeting the deadline is sufficient if the notice is sent before the 14-day period expires. We will refund all payments, including standard delivery costs, within 14 days of receiving the returned goods or proof of return. We may withhold the refund until the goods are returned. Direct return shipping costs are borne by you unless otherwise stated. You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods — normal unboxing and inspection is expressly permitted and does not void your right of withdrawal.

8.3 Eligibility for the 30-Day Guarantee

To be eligible for the voluntary 30-day guarantee, all of the following must be satisfied:

• The request is submitted within thirty (30) calendar days of the confirmed delivery date.
• The fountain is in its original packaging with all parts, accessories, and manuals included.
• You contact info@lovepetura.com to obtain a Return Merchandise Authorization (RMA) number before shipping. Returns without a valid RMA may be refused.
• The Product is received at our designated facility within fourteen (14) calendar days of RMA issuance.

Note for EU Customers: If your return falls under the statutory right of withdrawal (8.2), the stricter condition of Section 8.5 below does not apply — only the statutory standards apply.

8.4 Return Shipping

Unless otherwise required by law, return shipping costs are the Customer's responsibility. Use a trackable shipping method. Refunds are processed after the Product arrives and passes inspection.

8.5 Non-Returnable Items

• Products returned in materially damaged condition due to misuse, neglect, or improper cleaning.
• Products with missing or obviously destroyed safety or hygiene seals where removal prevents resale (e.g., sealed replacement filters). (This restriction does not apply to EU withdrawal returns of fountains themselves, which may be inspected.)
• Gift cards and e-gift cards.
• Free samples and promotional gifts; if included gifts are not returned, their retail value may be deducted.
• Products purchased from unauthorized third-party sellers. Lovepetura™ Products are sold exclusively through lovepetura.com.
• Items marked as clearance or final sale, where permitted by applicable law.

8.6 Refund Processing

Once we receive and verify your return, we will process the refund to your original payment method within ten (10) business days. For EU withdrawals, refunds are issued within fourteen (14) days as required by law and include the least expensive standard delivery cost. Original expedited shipping charges are non-refundable.

8.7 Damaged or Defective Products

If you receive a damaged, defective, or incorrect Product, contact info@lovepetura.com within seven (7) calendar days of delivery with photographic evidence and your order number. EU Customers additionally have statutory warranty rights (including a two-year legal guarantee for conformity defects) that remain fully unaffected by these Terms.

8.8 Payment Disputes

If you have a concern about your Order, please contact info@lovepetura.com before initiating a chargeback. We will always attempt to resolve issues fairly and promptly. Chargebacks initiated without prior contact may result in suspension of your account and cancellation of pending orders; however, nothing in this Section waives any statutory right of a Consumer, and we will not pursue enforcement actions against Consumers acting in good faith.

8.9 Abuse of the Return Policy

We may limit or refuse returns and refunds for Customers who demonstrably abuse the policy or act in bad faith, always subject to mandatory statutory Consumer rights.

9. Intellectual Property

All Content on the Site is the exclusive property of Lovepetura or its licensors and is protected by copyright, trademark, and other intellectual property laws. No Content may be reproduced, distributed, modified, or used without prior written consent.

10. User Content and Reviews

If you submit reviews, comments, or other content, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, adapt, publish, and display such content for any purpose, including marketing, without compensation. You confirm that your reviews reflect your genuine experience. (EU Consumers retain their moral and personality rights to the extent provided by mandatory national law.)

11. Prohibited Uses

Purchasing Products for resale without written authorization; placing fraudulent Orders or using stolen payment information; circumventing or interfering with security features; transmitting spam or malware; impersonating any person or Lovepetura representative; overloading or impairing the Site; harvesting other users' personal information; or any use in violation of applicable law.

12. Disclaimer of Warranties

THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, to the maximum extent permitted by law. Statutory warranty and product liability rights of Consumers, particularly under EU law, remain unaffected.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVEPETURA AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, product liability under applicable law, or any other liability that cannot be excluded under mandatory law (including German statutory liability rules).

14. Indemnification

You agree to indemnify, defend, and hold harmless Lovepetura and its owners, officers, directors, employees, agents, and affiliates from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, infringement of third-party rights, or misrepresentations made by you.

15. Assumption of Risk

By purchasing and using any Lovepetura™ Product, you acknowledge and voluntarily assume risks associated with its use, including allergic reactions or adverse effects on your pet, product interactions with other items, and electrical hazards arising from misuse contrary to instructions.

16. Privacy Policy (GDPR)

Your use of the Site is governed by our Privacy Policy, incorporated into these Terms by reference. For Customers in the EU/EEA, we process personal data in accordance with the EU General Data Protection Regulation (GDPR). You have rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with a supervisory authority (in Germany, e.g., your Landesdatenschutzbehörde). By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

17. Third-Party Links and Services

The Site may contain links to third-party websites or services. We are not responsible for their content, privacy policies, or practices and do not endorse them.

18. Provider Identification (Impressum)

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. However, this choice of law does not deprive Consumers of the protection of mandatory provisions of the law of their country of habitual residence (Art. 6 Rome I Regulation). EU Consumers retain the right to bring proceedings in the courts of their place of residence.

20. Dispute Resolution

20.1 Informal Resolution. Before initiating formal proceedings, please contact us at info@lovepetura.com and allow at least thirty (30) calendar days to resolve the dispute informally.

20.2 Binding Arbitration (Non-EU Customers). For disputes not governed by mandatory EU consumer protection rules, unresolved disputes shall be resolved through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. EU Consumers are exempt from this arbitration obligation; EU Consumers may instead use Online Dispute Resolution (ODR) or the applicable consumer arbitration boards in their country, and their statutory judicial remedies remain unaffected.

20.3 Class Action Waiver (Non-EU). To the extent permitted by law, claims may be brought only in individual capacity, not as a plaintiff or class member in any purported class or representative action.

20.4 Small Claims Exception. Either party may bring an individual action in small claims court within its jurisdictional limits.

21. Force Majeure

We shall not be liable for failure or delay caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, carrier failures, supply chain disruptions, labor disputes, or acts of war or terrorism.

22. Electronic Communications

By using the Site, you consent to receive electronic communications, including order confirmations, shipping updates, promotional emails, and policy changes. You may opt out of promotional emails at any time via the unsubscribe link or by contacting info@lovepetura.com. Marketing consent is given voluntarily and may be revoked at any time with effect for the future.

23. Severability

If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force.

24. Entire Agreement

These Terms, together with our Privacy Policy, Shipping & Return Policy, and Withdrawal Policy, constitute the entire agreement between you and Lovepetura regarding the Services.

25. Waiver and Assignment

Failure to enforce any right is not a waiver of it. You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations.
